By including outplacement in the settlement agreement, the company commits to funding professional career transition support for the departing executive.
NAKAMA EUROPE supports C-level executives and senior leaders across Europe in English and German through Inverse Headhunting, Executive Career Coaching and Executive Branding & Communication.
Why companies include outplacement in the settlement agreement
Employees notice how a company handles an executive’s departure. Professional career transition support can help maintain trust and bring the working relationship to a respectful close.
A clear agreement sets out what support the executive will receive and which services the company will fund.
Support can begin before the last working day, for example during garden leave. We agree the start date in advance.
What the outplacement provisions cover
- Service and scope. The support to be provided, or the services the executive can choose from within the agreed framework.
- Provider. Whether the agreement names a provider or allows the executive to choose one.
- Fee. The agreed fixed fee for the selected service, invoiced to the company.
- Start date. For example, once the agreement has been signed, including during garden leave.
- Duration. Depending on the service, NAKAMA’s support runs for three to nine months.
- Confidentiality. The content of personal discussions remains confidential. Any agreed reporting is limited to administrative milestones specified in advance, such as when the support begins and ends.
Legal drafting
How the commitment is worded in the settlement agreement is a matter for each side’s legal advisers. NAKAMA does not give legal advice.
How it works with NAKAMA
Before the support begins, we agree the scope of support, timeframe, designated points of contact and confidentiality arrangements with the company. We also agree a fixed fee.
The support begins with a confidential conversation with the executive.
Where several executives require support, we can establish a common framework while tailoring the support to each individual.
